If you're both legally drunk, yes.

If that glass or beer caused you to blow over .08, then yes.
Regardless, even if you blow under .08 on your drive home with the beer, then you'll still get an open container, so...why risk it?
Can't you wait to drink until you get home like the rest of us normal folk?
