The current owners can't legally sell if it doesn't have a modad. They would have to have it changed out. I moved from a house that had sewage to one with a modad. I was told to get rid of the garbage disposal because they can clog up the lines if you aren't careful what you put down it.

ETA: Also, I believe modad's are required to have a service contract where the company will come inspect it every 6 months...not sure anyone actually does that though.
