Reading some of the comments from the wafb article according to people who were there they were riding a side by side, not a 4 wheeler with the kid on the back. Is it to far of a stretch for you to think that an accident actually occured????

That's why he was charged then, shouldn't have let kid ride back there

I'm going off of what was posted in this thread .. Most have said the kid was on the back .. Side by side ?? On two different ATVs ? Please elaborate ..

That is what it sounded like from the initial info, which doesn't help the driver's case at all.

There are a lot of types of side by sides. The sportier models all have seatbelts. This one sounded like it might have been a polaris set up for hunting. If he was in that type of model and he was show boating around with a 12 yr old just sitting in the small bed in the back unrestrained (obviously because those models aren't made to carry passengers there)

that would be gross negligence. (in that scenario)
