Well first, I am not a lawyer, just an engineer. I am married to one though. Even if I was a lawyer, I would tell my clients to comply to the extent of the law. Let me give an example.

I get pulled over on I-10. Cop gives ticket. After giving my ticket, he then asks to search my car. I decline. He then says that I will be arrested for disobeying a lawful order if I don't comply. From what I understand, I waive my 4th amendment rights by saying yes.

According to you, I should consent, because the cop can kill me, arrest me, and give me a bad day if I don't. That's no different than a criminal pointing a gun to my head and demanding I do something. Is that OK with you because he has a badge?

I only know of 2 options...declining and probably having the cop respond by calling in a K-9 unit or allowing the search...is their another option?

I am not telling you what to do. I am telling you what I do to avoid the possibility of being jammed up or worse by a cop on a power trip. I was pulled over recently by a cop in Mississippi for a bullshite reason and let him do his thing and was on my way 3 minutes later.

I have never said it was ok for a cop to abuse his power...merely stated I know it is a possibility he will and choose to make my decisions on how to deal with them knowing this is a possibility.
