I wouldn't count on anyone getting a BAC anytime soon. Apparently now NYPD feels to need to get a warrant to check their alcohol levels. Driving down the wrong way down an interstate and killing your passengers after leaving a strip club doesn't qualify as probable cause or even reasonable suspicion for those with a badge.
That's also curious because NY has implied consent laws. They don't need a warrant. It should also be noted that the truck driver was tested at the scene, but not the other driver.

Those charged with upholding the law certainly should be held to a higher standard than the average Joe.
