that's a defining part of manslaughter. and why he wasn't charged with murder.

quote:
He didnt intentionally try and kill the guy.

and that's why he was charged with involuntary manslaughter. you may disagree with the sentencing range, but you pretty much just agreed the actual charge.

yeah he killed someone.. i understand that

very few situations exist where you take an intentional act, especially one intended to harm another (like say, hitting someone) that kills a human being, where you won't go to jail. as it should be

i 100% agree with the charge you are right... i just think the 8 years is extreme for an isolated incidient "if that is the case"

any individual's death is an "isolated incident." only happens once. and as mentioned above, it last a lot longer than 8 years. whether or not the violent act was intended to cause death, it did. he should have known it could cause death, because shite happens. any time you strike a person, you open yourself up to that risk. he took it. it may have been a fluke, but that doesn't matter to the dead guy or his family.

as a side note, I'm starting to believe that the stupider the reason for killing someone, the stronger the sentence should be. a red card is a damn dumb reason to take a life.
