Now that is a creative reading of the constitution.
We the people have the right to marry, and we have the right to our government protecting our married rights. We also have the right to due process, and preventing someone from signing a legal document on the basis of sex alone violates that right. I am right and will be proven so sooner or later.
If the issue of two citizens consenting to a legal marriage bothers you, the loser in this case is you and you only.
