He could be, but his story is incredibly suspicious. They were sharing a cigar? Cigars smell nothing like weed, so I'm sure there was smell in the hotel that whoever caught them knew. I think kubiak just plain didn't like Sam and his work ethic and saw a chance to get rid of him.
It's kinda telling that kubiak forgives steroids users that can tackle and welcomes them back, but let's go of a guy for pot.
