In Delta3504's defense. I see this all the time. She couldn't refi until the divorce was final and the property settlement was done. Then, the courts usually give them a year or two to get it done. I have a friend that can't refi hers because she filed bankruptcy so I had to send her a letter of credit denial to present to the court and the attorney's.

Only way off is refi. Mortgage company will not let either borrower out if she has bad credit. That would be stupid. They can go after both and that spreads their risk. It also gives them someone to call when the payment is late. If she isn't paying on time, contact them give them your situation and ask to be notified if it is late. Then pay it to protect your credit, then sue her for the house back or the payments.
