CPA's or other people dealing with LDR - not Flex Fuel related

Anyone ever deal with the LDR once they have turned you over to a collection agency? Here is situation without details:

LDR turned in a taxpayer over something they did not know about.
They claim they sent 5 notices, and a warrant certified.
We have since found out they had the wrong address.
There are several issues with the amount of tax they are charging the taxpayer. Certain nontaxable items that are cleary written in the law.
The collection agency is about to put a lein on their accounts.
We have contacted the LDR stating our case and ask to put a hold on the collection until we can gather information.

There response: Once we turn an account over to DCS, we can do nothing more. Instructed us to pay the amount to the DCS, then apply for a refund based on our information. Sounds reasonable, but the difference is about $25,000. And a certified letter must be signed by the receipent.

Any thoughts? the taxpayer has contacted a lawyer, and I am trying to talk to someone higher up at LDR.

I worked on an issue for one of my clients for 7 months and got nowhere. My client had also been turned over to a collection agency. He did not owe the additional tax the DOR had charged him with. In fact, they owed him a refund for the particular year in question had they processed the amended return that was sent to them 9 months prior to the first letter they sent my client.

I wrote up a summary of the situation and brought it to my local State Representative's office. They contacted the DOR and were able to accomplish in 2 hours what I tried to get done in 7 months to no avail.

You cannot deal with the DOR alone. They will not listen to you but will certainly listen to one who feeds their budget, etc.....

Good luck! I know how frustrated you are. Contact either your local Senator's or Representative's office and watch how quick things will get settled!
