Hang on to those refunds, fellas...best put them in a savings account cause I'm afraid the State will ask for them back eventually!

I too called the Dept of Revenue and was told that yes, my E85 truck purchased in 2008 qualified for the $3,000 refund and to be sure to file an amended return prior to 5-15-12 as the time to file a 2008 amended return will expire after 5-15-12.

Only problem I see....no, not the only problem, but here goes: R.S. 6035 REPEALED AND REPLACED R.S. 47:38 that dealt with vehicles purchased since 1991. R.S. 6035 is for vehicles purchased on or after 1-1-09. R.S. 6035 also added wording to the definition of "qualified clean-burning motor vehicle fuel property" that the original bill did not have. It states that it "SHALL NOT INCLUDE EQUIPMENT NECESSARY FOR OPERATION OF A MOTOR VEHICLE ON GASOLINE OR DIESEL".

The credit that was available for a vehicle purchased in 2008 wasn't 10% or $3,000 whichever was less....it was 20% of 10% (no joke) or .02% of the cost of the vehicle or $1,500 whichever was less.

Therefore, the Customer Service Dept. at the DOR was incorrect in that the Flex Fuel vehicles qualify for the credit....and by telling taxpayers to hurry up and file their amended returns for 2008 so they can get their $3,000 refund is totally absurd. Under the law that was repealed that gave the credits for 2008, one would have had to pay $150,000 for a vehicle ($150,000 x .02% = $3,000).

Inasfar as the 2009, 2010, 2011 and 2012 models qualifying for the credit, the Customer Sercvice Rep referred me to the outdated bulletin for the law that had been REPEALED. She said the Customer Service Reps and their supervisors had a big conversation recently about these refunds.

GOD HELP US ALL.....There are thousands and thousands of these Flex Fuel vehicles out there. The Model T was the first vehicle that ran on either ethanol or gasoline.....I do know for a fact that the matter is being reviewed by the DOR's legal department....just DON'T SPEND that refund until they rule.

Bobby think he has budget problems now....just wait til these $3,000 refunds really circulate and bankrupt the State.
