You have to take that quote in context:

"If any crime was committed by Jordan Jefferson, it was simple battery," Unglesby said. "It's rare for a person to get arrested for a felony when no gun was used."


Unglesby is simply saying that even if all the allegations are true, Jefferson still shouldn't have been charged with second degree battery.
