Most of court jurisdictions don't hold up terms of service agreements because you arent capable of returning the item after you bought it. Example is software. Once the wrap is broken you cannot return yet you get the terms of service after it has loaded in your computer.

Companies use these to make people think they can't sue. Also, it is used to say they knew the risk.
