For fraudulent misrepresentation. This according to several legal analysts on twitter.

I believe the SEC would have a better case than Baylor does.

Baylor would not prevail in a tortious interference suit any more than the Miami Dolphins would in a suit against Alabama. In the sport of college football, the common course of dealings is that contracts are broken and buyouts are given in consideration all the time.
