The same way any other improper recruiting contact is cheating. There are reasons for these rules, and whether you think they make sense or not -- and even whether they actually do make sense or not -- the choice is simple: you choose to follow the rules or you choose to cheat. There is no middle ground. He chose to cheat.

And pointing out that some cheating is worse than other cheating does absolutely nothing to change the fact that it is all still cheating. The fact that theft is a less serious crime than murder does constitute a defense; it's still a crime.
