Yes, they do. What they aren't telling you is that this is not regarding the actual crimes that trump is Bing charged with.
Trump has been charged with crime A. If trump committed crime A in furtherance of another crime B, the prosecutor can bump up the charge for crime A. But they don't have to charge him or prove that he committed crime B. They only need to prove guilt of Crime A.
