Why tie up all your liquidity with a bullshite court case if you can get a bond? Or if you can shame them into continuing to lower the threshold?

Right - this is already a win. He can probably get someone to issue $175 where half a billion would cause folks to balk. Also, the fees are going to be much more palatable at $175 - if linear, it drops the costs to 1/3 and then makes it a better A to B analysis on whether or not to just post it cash or pay for a bond.
