There are lots of businesses that are not allowed discriminate based on race OR gender. By lots, I mean EVERY SINGLE ONE except insurance.

Life insurance does the same.
Health insurance used to do it before ACA. Now, everyone is lumped together in an age band. I don't even think health insurance rates (approval maybe... rates no) are affected by smoking.
