E and O is common, sue him for negligence and his E and O carrier will pick up his defense and likely settle. Very common. You have a negligence cause of action.

If there wasn’t a lapse in coverage there is no negligence. This board is full of sue happy fricks who then wonder why LA sucks so bad.
