They incorrectly interpret Section 3 of the 14th, but they also just flat out ignore Sections 1 and 5.
Insurrection is a Federal Crime. You cannot convict someone of a federal crime in a State Civil lawsuit

This is a situation where a filing fee of say ….$100,000 is justified simply for the annoyance.
