Wrong. It would be a necessary precursor to court. If either side disagrees with rulings of the arbitrators they may take it to court. Loser pays.
Most civil matters are already settled out of court. Today plaintiff lawyers inflate claims to collect contingency fees. I want a plaintiff to have good, well paid attorneys regardless of the size of his claim. If a defendant is stupid enough to fight a good $1000 claim until the legal fees are $100k then he will have to pay.
By the same token no mass tort plaintiff lawyer looking for dumb jurors to make rulings based on science should be able to bring such cases without some financial risk of his own.
