I’ve represented several large, cost-conscious, public companies who have brought money-losing suits to make a point or set a precedent. An example of this is media companies suing people who download music or videos. (I’ve never been involved in this litigation, and I’m not saying whether I agree with their tactics—just using as an example of litigation motivated by something other than direct money recovery.)
I agree that at some point they will overcome their fear of defending ridiculous lawsuits if backed into a corner. But I wish they would take it one step further and countersue the would-be thief. Go scorched earth, take everything they have, garnish their wages if possible, etc. Woke policies aside, there are probably good business reasons not to do this (e.g., optics, perhaps), but I’m a vindictive bastard when it comes to stuff like this.
