You can FOIA video footage from libraries and they have to give it to you
not if they don’t keep the footage - and not all library records are subject to FOIA

not necessarily, some library records require a subpoena

What would a library recording fall under from the below to make them exempt from FOIA and require a subpoena?

quote:

What are the three exclusions to the FOIA?

Not all records are required to be released under the FOIA. Congress established nine exemptions from disclosure for certain categories of information to protect against certain harms, such as an invasion of personal privacy, or harm to law enforcement investigations. The FOIA authorizes agencies to withhold information when they reasonably foresee that disclosure would harm an interest protected by one of these nine exemptions.

The nine exemptions are described below.

Exemption 1: Information that is classified to protect national security.
Exemption 2: Information related solely to the internal personnel rules and practices of an agency.
Exemption 3: Information that is prohibited from disclosure by another federal law.
Exemption 4: Trade secrets or commercial or financial information that is confidential or privileged.
Exemption 5: Privileged communications within or between agencies, including those protected by the:
Deliberative Process Privilege (provided the records were created less than 25 years before the date on which they were requested)
Attorney-Work Product Privilege
Attorney-Client Privilege
Exemption 6: Information that, if disclosed, would invade another individual’s personal privacy.
Exemption 7: Information compiled for law enforcement purposes that:
7(A). Could reasonably be expected to interfere with enforcement proceedings
7(B). Would deprive a person of a right to a fair trial or an impartial adjudication
7(C). Could reasonably be expected to constitute an unwarranted invasion of personal privacy
7(D). Could reasonably be expected to disclose the identity of a confidential source
7(E). Would disclose techniques and procedures for law enforcement investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure could reasonably be expected to risk circumvention of the law
7(F). Could reasonably be expected to endanger the life or physical safety of any individual
Exemption 8: Information that concerns the supervision of financial institutions.
Exemption 9: Geological information on wells.

I had a run-in with a cop with little man syndrome earlier this year.
I’ve had many run in with cops - even at the public library!! (BRPD is worthless btw) I’m not protecting the cops at all - I’m protecting the librarian at the circulation desk that may or may not have a stalker - recording may be legal but it’s weird and could be dangerous

Yes they are unless they meet any of the 9 exemptions I listed above. All Government records are subject to FOIA unless they meet one of the exemptions

Records of video surveillance in the library are protected under the same considerations of privacy and confidentiality as all other library records, and the same rules and guidelines for access apply. Libraries should consult with legal counsel about applicable laws governing the retention and release of video surveillance records.

So I guess exemption 6

That does not mean they can deny FOIA requests. FOIA would be pointless if it could just be ignored without a clear reason as to why. The 9 reasons are pretty clear.

No. Did you read 6?

If you are in public you are giving consent. That does not equal an invasion of your personal privacy.

many foia requests are flat out ignored or denied, plus privacy issues can always be used

#6 is the reason unless you have a subpoena

so you want recordings of the librarians doing their job??

FYI - most libraries’ cameras are not on the employees unless there’s a money drawer involved

no I’m not - you are wrong bc you think you can just request something because if foia and have the information handed to you. It doesn’t work that way. Foia applies to federal agency for the most part - states and local governments have their own laws concerning information - and it’s not as easy as filling out a form.

I think most of these people are clowns but Sean is a good dude who has gotten better over time. I dont follow many people on YT but I enjoy his content and usually watch all his videos. Hes spot on for ensuring public officials treat the public with respect.

yes, you got me

I was reading books that were not about the constitution bc I’m just a librarian not a lawyer or law enforcement officer - I give you a due date, read a story to your kid, and put stuff back on the shelf where it belongs so other people can find it

Please don’t record up my skirt

Nope. I worked at the public library for a while - I don’t anymore bc I don’t believe in tranny story times

The library I worked at did not have cameras - but probably should have

Wrong again, I worked for local government and my pay stubs, expense reimbursements, and agency credit card statements were requested. After reviewing with our attorney, my personal information was redacted and everything was sent.
