Yeah, no it's not. I suggest looking into it. And my original comment was in no way defending the practice. It's ridiculous. Also, ask your local waffle house server if they bump them up to minimum wage on shifts where they only make 23 dollars in tips. Lots of them don't.

The IRS taxes you on money verifiably paid to you. The IRS does not tax you on some formula of "what you theoretically should have made". You are ridiculous.

My wife's sister was a Waffle House Waitress for 5 years.

This is a completely different subject, and has nothing to do with your claim that people get taxed based on what they "should" have made with tips based on register receipts. You are absurd. You have absolutely no concept of PCI governance, tax law, labor law, POS systems, payroll system integration, etc.
