If the crime alleged had prescribed, or in that state it would be “statute of limitations had run,” which I don’t know how it could not have, then a judge will have no choice but to quash the indictment. In that scenario, if the trial judge just shite himself and couldn’t bring himself to make that decision and ruling, then the next court up the chain would do so.
