And in that case, not just half but I imagine a penalty for not disclosing so you'll inevitably lose most of it.

Not most. However, the judge will probably sanction you for the cost associated with finding and having a trial or hearing over the matter -- including all court cost and attorney's fees. The judge will also be extremely pissed at you, won’t believe a word you say, and will look to f*ck you in other ways - Lord help you if children are involved and custody and child support need to be determined.
