The judge sentenced him to 4 months but said he can stay out of jail until the appeals process is over.

Let me interpret it another way. The judge charged Bannon with contempt of congress but said he had three points that he would likely succeed on appeal. By convicting Bannon the judge remains in good status with the DC cocktail circuit. By allowing Bannon to work through the appeal process before doing his time keeps the judge from being admonished by the higher courts.

When the GOP takes congress the charge will be dismissed upon recommendation of congress and Bannon will not have to appeal.
