It's not exactly myth. 9 wins (3 losses in a 12 game season) would make them eligible to be picked if they are also ranked in the top 14 (I think). Originally the ranking criteria wasn't applied as that was a later addition. I don't know, but they probably haven't had just 3 in the BCS period. However, if ND was in that situation, most likely a bowl would pick them because they are good for business, but they are not guaranteed a spot like a conference champion is. These are fair rules for a team like ND and no one should think they are somehow getting ultra special treatment.
