Big East to make TCU pay exit fee?

"The source told ESPNDallas.com that TCU would have to pay the $5 million exit fee from the Big East but could join the Big 12 in time for the 2012-13 athletic year. A source with knowledge of the Big East's situation said the league is prepared to see TCU leave before it ever plays a game."
I personally think thats stupid. Especially since the commitment hadnt even started, and the conference is falling apart. That isn't what TCU signed on for and had no vote or say so in expansion/trying to keep teams.
Thoughts?

I am sure they signed a contract. They knew the deal going in. They should pay the money.

5 million is small cookies in this game of realignment.

Yeah the jumped the gun on that whole deal, i know hindsight is 20/20, but did anyone really think this expansion talk was just over

I think TCU should be able to give them the finger since they haven't officially entered the conference yet.
That being said, the Big East is a dead man walking. Even if they don't lose anymore teams to the ACC, Big Ten, Big 12, or SEC, they have to get up to 8 teams in the conference ASAP or they risk losing recognition from the NCAA.
If they lose recognition by the NCAA, bye-bye auto-BCS bid.

This is probably what the Big East expansion office looks like right now.

They did sign a contract, but Im sure with Sorrycuse and Pitt leaving that could be some sort of contract exception. That would not be the conference that TCU agreed to. And since they havent OFFICIALLY become a member/have no vote or say so in any form for the conference, how really could they be held to it?

Ridiculous. I realize that $5 million may not be that much for these conferences, but in this age of economic uncertainty, I find that to be uncalled for.

It is stupid, and won't hold up in court. TCU clearly can state the conference they signed up to join no longer exists as when they agreed to it. The league technically does not have enough teams to survive at this juncture and TCU can claim the reduced quality of the teams that would be brought in to replace Syracuse and Pitt will hurt them.
Any reasonable judge would rule in favor of TCU.

TCU won't have to pay a dime. They executed the agreement under the premise that the Big East offered certain advantages and those advantages have been devalued with the exit of major (at least for the Big East) markets and the erosion of the TV contract values on a long term basis.

They signed a contract to join the Big East an auto bid conference which no longer exists by no fault of TCU. TCU will not have to pay a dime.
Even if they do have to pay it it could be donated easily. The 148 million dollar stadium expansion was funded by 15 donors.
