"Subject to the jurisdiction thereof" could be a textual argument. Doesn't seem sensible that running for the border makes your children citizens when you're not supposed to be here.

This phrase applies to ambassadors and visiting foreign dignitaries. If the alien resident isn't subject to the jurisdiction of the U.S., they can't be brought into a U.S. court

This is not true… there are close to 50 countries that offer birthright citizenship. 35 that do it directly and and another 20 or so that give visas to live there permanently if they choose.

I’m not saying I agree with it, but don’t lie to make your case.

Are you sure the authors of that verbiage meant it to apply for pregnant women to break into the country illegally in order to drop their kid on this side of the river?

I would say that it would apply to anyone who came here legally and applied for naturalization.

It certainly should not apply to anyone who broke our laws in getting here - they and all their progeny should be deported immediately.

Well, you seem to be heading down the right path. Why would ambassadors and foreign dignitaries not be subject to iur jurisdiction?

You don't have to bring illegals into court. You can probe they have no right to be here and toss them out the back door.
