Property line question

Let's say "bob" and "joe" have property. There's a pond on both of their property because the property line is in the middle of the pond. Can joe put his boat in the pond on his property and paddle to bobs side LEGALLY?

LEGALLY you're probably in the right here. However, it's usually best to try to be amicable with your neighbors. He paddles on your side, you paddle on his side; who really fricking cares. Maybe one day the two of you could paddle the pond together over a beer.

Depends on how their deeds are worded (and how plat is drawn). Very possible that LEGALLY he can't do so.

However, KR makes a very good point about "good" neighbors.

I'm just a guy on the Internet, but I'd assume once you cross the property line in the middle of the pond you are trespassing. So if you are asking can he paddle to their land, I would assume you trespassed while doing so.

If the plat puts the property line down the middle of the pond, and if neither the deeds nor any covenants grant to the adjacent landowners a servitude of passage over the pond, then he cannot without permission. There are no navigation servitudes over private property in favor of private persons, at least under Louisiana law.

Like others have said I think unless is navigable then no you cannot cross the line legally.

Navigable is the word that gets a lot of folks in trouble here in Louisiana. That is the debate that has been going on between landowners and fishermen along the coast. Under Louisiana law, just because one can "navigate" a water body does not give the public the right to go upon private property.

Normally two guys who own adjacent properties wouldn't build a shared pond for that exact reason. If for some retarded reason the pond was split in half, you couldn't go on the other side

Yeah he already has the Christmas trees that's why bob would want to fish on his side. And there's no way in hell joe would willing let bob go on his side bc joe is a real dick. These property lines are not by joe and bobs homes. They are behind the levee. So bob is taking a chance that maybe joe won't be checking his land that day but if joe did check his land bob and joe would have words over it bc of the type of person joe is.
