Would it make a difference if this pond was being fed by the Mississippi River? Then wouldn't it technically be considered part of the river which no one owns?

I used to fish an oxbow off of the Red River like this. When the River got way up it would get muddy on that end and it was seepy at best, not free flowing water by any means. I don't know if it was "Navigable" or not...

Anyway, of the 4 property owners out there one was a dick and it became a 3 vs. 1 deal when the dickhead guy actually put up a roap with bumpers every 10 yards with signs saying "no trespassing do not cross" down his property line.

I didn't live out there or own any property so I just fished all over that son of a bitch and let the guy mean mug me. Thats what the other 3 told me to do...

Fwiw, the other 3 never gave two shits when dickhead guys son and his friends fished all over their side. It's a lake/pond, that's what its for. This guy was all stay off my stuff, but if you don't mind we'll come on your side. Some people can't understand that you are trying to be nice, instead they want to take advantage of you for being "stupid" and letting them on your side. It became a "Ha ha... I got you" one up game that was absolutely fricking ridiculous.

I haven't fished out there in years, but to my knowledge, it's still on going.

I don't understand people like that. I mean I like fishing but there's enough fish in the water for 2 people. It's not like I'm going to catch every fish and keep every fish I catch and then there will never be fish there again unless he has to pay to stock it.

Depends upon whether that pond was a part of the river at one time or created naturally by the river. If so, it may be public. If dug with private funds on private peoperty and connected to the river, then it is private.The source of the water is irrevelant. Confused yet?

But it would be split between two private owners. I would assume that there is an easement for the water area of the pond. Check the deeds.

Buy a seine and pull every fish outta that pond in one night. Have fish fries for the next few weeks outside so he can smell them but don't invite him.....

Under Louisiana law, just because one can "navigate" a water body does not give the public the right to go upon private property.


All running waters are public, navigable or not. Unless its water made with private funds. Then it's private.

So to answer the question...no the pond is not running water. However, if it is classified as a lake (not a privately dug pond) you're good to go. Lakes are public.

yup...down in Dulac there is a running waterway as part of the Grand Caillou system...Harry Bourg corporation has large pilings on either side of the waterway saying it is private property no entrance without a permit...some of you may know the area I'm talking about...this waterway is a good 100 yards wide and connects to Grand Caillou Bayou...the permit costs $100 per person per year to fish in that water...as I understand it this went to court and due to the corporation being politically powerful in that area the posting of the waterway was upheld...
