Yes. I've seen it happen recently with a case in Lake Charles.

ETA: Nevermind. They had a body but never found the gun.

I think you can if there is enough evidence of foul play, such as enough blood from someone being found that they couldn't possibly have survived, even if the body itself weren't found.

"Kergan was last seen leaving the Night Spot Lounge on Plank Road in Baton Rouge, Louisiana on November 28, 1984. He was accompanied by Leila “Erika” Mulla, a teenage exotic dancer, at the time. Kergan was wearing over $8,000 worth of jewelry and carrying $2,000 in cash when he disappeared. He has never been heard from again. His late model pink Cadillac was later found abandoned in Metairie, Louisiana"
