Sorry, but I've got no patience with a poacher. Same exact thing as a thief in my book and if you're stealing from me, your life is worthless to me. I'll shut my mouth about that before I go off on a rant.

How large of a piece of equipment would it take to pull the gate out the ground and drag it a couple of miles down the levee?

Well the mangled stop sign post wouldn't be hard. The gate can be done with a tractor or small track equipment.
I'll get this gate taken down or a key pretty easily. As i stated before, I have a 9am meeting with a lawyer and a big name land owner/powerful public figure who wants this gate down too. If this guy won't take it down then the law will step in on the civil side and I'll take the gate down. If i take it down I'm bringing it the .25 miles to my lease and I'll install it for my club. I have access to lots of steel pipe from offshore platforms and welding machines. I'll make a gate that takes a tank to get through

Well the ownership is clear as day in the courts. It's watered down within the family as in the offspring of the land owner think they own it. Maybe I didn't express that correctly.

Thib-tiger, with out giving too much info away I'll say this. The resident is a well known trouble maker in the area. Every law enforcement and public agency I talked to knew exactly who he was.

Legally likely nothing, in reality you are just going to escalate the situation with someone who has access to wreck your shite while you are gone.

This has to be carried out fully and legally or it will never end.

Met with lawyer. I don't remember his fancy lawyer talk but since my club has used this as access for at least 10 continuous years and article 689 section 3 applies to a land locked property - we need to be granted access via the levee.

Sine the land owner won't make his SIL take the gate down/give us a key they are both getting a letter from the lawyer to take it down in 5 days of receiving the letter or they both will be taken to court.

The old man land owner wants nothing to do with his SIL or courts so we think this will work. SIL already has felony charges so he won't want to mess with courts

Also the sherrif's office is going to pay the gate builder and land owner a visit becuase the gate builder did this illegally and can be charged with criminal mischief which can fall back on the land owner for not making him take it down or provide a key.
