This has been interesting to watch. Kudos to you for taking to proper steps to get this handled.

When I was a kid, we showed up to hunt our property and someone (not the landowner) had run a barbwire fence across the spot we would normally access our property from. My uncle had an old bronco with a big front bumper and drove right through it he was so mad. I have to say it was pretty fun as a 10 year old kid busting through that fence.

I put $300 worth if new cameras out there last week that better be there when I get back there. Got deer moving in but not the big boys yet

I called the old man land owner and gave him a heads up he can be charged and will be receiving a letter from my lawyer. He was cooperative and called me back 10 minutes later saying he will work on his SIL to take the gate down.

Well he was cooperative from day 1. He came and gave me written permission to pass. That was the wrong word. Let's say he was adamant about getting the gate down

Cut lock on the gate and lock the gate back with your new lock. Should be no reason for him to go through the gate correct?

That's my and land owner's entire argument. This guy has no reason to need a gate as 1) he doesnt own any land 2) the land owner's (aka FIL) land is only a few hundred feet of levee, nothing more. Gate or no gate this guy shouldnt be on any properties back there. We want the gate down because we don't want to have to deal with this guy or anything to do with him. Thats why i took it to a lawyer and pushing for the gate removal not just a key

This guy thinks he owns everything and wants everyone else out so they can do their thing without getting caught.

You need to get an agreement written up with the landowner, while you have his ear, that attaches the right of access to the property you are leasing. Once drafted and signed go record it.

Sounds like the SIL will have ownership at some point.

i did. Monday i had the land owner sign access to my club to pass over the levee to our lease. A copy was given to the lawyer and enclosed with the letter that was mailed today. I also sent it to my landowner so he can record it.

Update - kind of...Gate is still up so knowing they will be receiving the attourney letters tomorrow, I called the land owner to keep the pressure on. Long story short after a positive conversation he said if the SIL doesn't take down the gate upon receipt of the letter then we will go take it down. At the end he said "don't forget I like back strap if you kill one this season". Well I had some in the freezer. Being the land owner lives a mile from me I swung by and dropped off some back strap, quails and pheasants. Also recognized him as the guy I pulled out when he was stuck on the damn levee earlier this year. Ended in a hand shake and feeling good that this gate will be gone within 5 days of tomorrow

Update:



Passed my lease and saw the law taking to the gate builder. Cooler heads prevailed and until he proves my club wrong he let me cut the gate. He is convinced my 30yrd old club doesn't exist and my land owner is fictional. He will be disappointed when the gate is never closed again.
He's also convinced he has a say so in the land the gate is on which is false and he doesn't understand right of ways

That's all it boils down too. Went pull down my cameras to be safe. Tonight i'll post some pictures that make it all worth it
