If I name my kid God, can he just go around effing peoples shite up and then their insurance would have to cover it since it was "an act of GOD". I think there's a legal loophole here that we can get stung by.

Technically you are off the hook if the tree is healthy.

Be a good neighbor and split the cost.

If he is a good enough guy that he would have split the cost to get the tree trimmed, then pay half.

If he would have laughed in your face, then follow the law.

When my trees fall they go big. Totaled the neighbor's house a couple of weeks ago. The neighbor settled up with his insurance co. and told me to tell whoever cuts what's on my property to throw all their cigarette butts at his house.

Most people don't, but that's a decision everyone makes on their own, depending on whether they'd rather pay a higher premium and lower deductible, or vice versa. It doesn't change whose responsibility it is. I may give him half just to keep the peace but I want to talk to an insurance agent first. I just hope he's not miffed I'm only paying half since he asked if I'd pay the whole thing. Frankly I feel like I'm doing him a big favor to offer a split.

<<< also an adjuster, and I can tell you you 'owe' nothing in this case. Even if the tree was rotten, he would have to show evidence that he asked you to remove it prior to it falling, like sent you a certified letter or something of the sort.

Louisiana now allows for subrogation of the tree/ tree branch removal regardless if the tree is dead or healthy...
