Obviously not condoning this retards actions that night. My only concern is these stories normally involve teenagers or young adults that have maybe 3-5 years tops of sexual experience. What I mean is, the aggressor may not know what constitutes right or wrong because of lack of experience.

She was passed out and blind drunk.

In my example, using underage drinking, it doesn't matter what crime I used. Speeding, armed robbery, what ever. If someone uses a gun to rob a 7-11, then the DA convicts them of shoplifting, they still committed an armed robbery.

Whatever he was convicted of, the punishment does not fit the crime. That is why the Judge that under sentenced him caught hell.

Everyone reacts differently to alcohol...some never remember the stuff they did while drunk and others remember everything

I still party on weekends and have blacked plenty in my life. I've been beyond "impaired". I would never frick an unconscious woman. I have had plenty of drunk chicks pass out around me in college, that thought has never entered my drunk mind or my sober mind.

A person can either do that or they can't.

Think about the act of undressing and violating a completely limp, unconscious woman.

I knew undressing and sticking my pecker in an unconscious woman was wrong when I was 13 years old with no sexual experience besides grabbing a boob or two.

There is absolutely zero moral ambiguity there and anyone smart enough to get into college, much less Stanford, would 100% know that.

I agree...but some people that are impaired it would even though it may not if they were sober. Do you disagree? People do things they wouldn't do all the time because they are impaired. It still doesn't condone it.

Funny story, I passed out mid-blow job in college once and she slapped me while I was asleep to wake me up and I wouldn't so she left me on my couch with my pants at my ankles for my roommates to find me when they got home.

And we kept our AC on 68. Thank god no pictures were taken

Assuming this is so, you certainly could say it lessens the intent.

But...being drunk doesn't absolve you from a crime, whether it's murdering someone or having sex with an unconscious person, so it's still sexual assault either way, or at least should be.

At the end of the day, I doubt the trauma the girl faced would really matter much knowing he knew or didn't know what he was doing.

The whole reason he didn't get charged with rape is because he didn't have sex with her.

He fingered her, which is sexual assault under California law, and he was sentenced for that crime.

They are increasing their penalties for sexual assault now, I believe.
