Quick question, under the handbook, what due process is he entitled to? Or does he think he plays by his own rules and not the LHSAA

LINK

If I were Newman I’d fire him ASAP for just inviting the LHSAA to come to court and drag the school, really.

Now will the LHSAA come with receipts?

Plus he’d be coaching in violation of his suspension. That’s willful

So now that LHSAA has been named in a lawsuit, they can make everything public to defend themselves, right?

my guess this is a ploy by RL to get money out of Newman or the "backers" of what he was doing.

The documents could be sealed because it involves minors.

follow the money trail who is paying for his lawyer -because it's not newman.

Why do you not think Newman is paying for the lawyers? Protecting him protects their reputation.

Newman is not they did not want him to sue.

Because of the violations Lhsaa rules and enforcement history is consistent in regards to sanctioning coaches that were involved w violations.

No other school has sued nor any other coach over this type of sanction.

He’s grasping at a straw not straws

Who was the assistant that went to the Lhsaa. He was to take the fall for Randy but decided not and told everything about what was going on. Also was told several parents and boosters were not happy with the coaching. If you are going to cheat you better win big time games, by big numbers. It was also mentioned that kids who were brought in and decided to leave were found inelgible at their old schools, so the kids started talking. What about their due process, Randy?

All that went to schools in their home zones were eligible.

I believe parents went to school and school then went to Lhsaa

Asst did right thing

All this from a school that got one of the kids

Heard that the AD was demanding money, meals, and hotel rooms for some of the big time events they have been to during the year. I can understand meals and rooms getting some help, but as much stroke Randy has with nike why did they need any financial help at all. Why wasn't the AD's name ever brought up in any of this. Surely he had to see what was going on and just turned a blind eye to everything.

I'm sure choupique was referring to South Lafourche and the jobs/living accommodations Chouest was providing. Literally the entire population from down the bayou was in the Cajundome the 2 years SL made it.

And Newman basketball is getting what they had coming.

As interesting as that situation was, Thon actually sat out his 8th grade year because he was ineligible. Country Day didn't get him a fake air bnb to live in and "pay bills." That's a long story, but his guardian was selling him to the highest bidder the summer before he left. Pretty fricked up situation.

Another thing Country Day doesn't do is tell kids that have been there for years to leave because their spot has been filled. Randy did that to multiple guys this year, including a 6'9 surefire D1 prospect who's now at a prep school. This is also a kid with deep New Orleans ties and family money. Just stupid on Randy's part.

Apparently Newman fired someone earlier in the year who was keeping receipts. If Randy knew what was best for him and Newman, he'd ride this suspension out and not complain one bit. If this "lawsuit" actually makes it's way into litigation, he and Newman are beyond fricked. The LHSAA will depose one witness and get everything they need to punish them, even if they violated his due process the first time around.

ETA: posts above me are correct. The fall guy did not appreciate being the fall guy and he was objectively the wrong guy to make the fall guy. When I said he was keeping receipts, I meant literal receipts

Yeah a lot of the LHSAA membership probably has no love lost for Newman even more than John Curtis or any Catholic League school

Newman’s Randy Livingston can return to coaching after judge's ruling

quote:

Newman boys basketball coach Randy Livingston has been granted a temporary restraining order that should allow him to return to the team bench as soon as Saturday.

The Louisiana High School Athletics Association suspended Livingston for a year, for allegedly violating rules on player recruiting, but Livingston said in a lawsuit field Thursday he was denied due process, specifically a hearing on the allegations before a decision was made to suspend him.

An Orleans Parish Civil District Court judge issued a motion Friday that allowed Livington back on the basketball court until a hearing scheduled for Jan. 18, when the LHSAA will be asked to explain why the order should not continue.

The court order also put on hold the LHSAA decision that called for Newman to forfeit three seasons worth of basketball wins and barred Newman from the state playoffs this season. The Uptown New Orleans private school has won state championships in each of the past two seasons and could win a third in a row this year.

The court initially called for a Jan. 18 hearing that would have provided a chance to Livingston to argue why he should return to the bench. Instead, Livingston has been granted the ability to coach at least until the mid-January hearing.

Not really. It's not super uncommon for a TRO to be ordered in a case like this, especially in CDC where the judges generally don't know what they're talking about.

After reading the suit (skimmed, forgive me if there are mistakes), Randy is suing the LHSAA and Newman. His basic allegations are that the principal was never afforded a hearing (required by LHSAA bylaws) and the LHSAA never presented the proof of cheating. Further, he's arguing that the LHSAA suspending him constitutes a state action which gives rise to a due process claim. It could, it could not. I wouldn't bank on a CDC judge to give the proper ruling.

Gibby Andry is his attorney.
