If it is on the books as a felony, it's a felony. If you don't like it, lobby your legislature to change the law.

There are some crimes that are so evil they are a moral obscenity and the very definition of mens rea which is a guilty mind.
People who do shite like this are fricked up in the head and need to be monitored extensively in a mental institution as a crime like this is one of the most unempathetic, cruel and inhumane acts in existence.
