If they want the Joker back in the film they should recast the role. Using unseen footage of a dead actor from a previous film is a little tacky. I would see it as doing a disservice to the work he did in TDK.
The Joker was great, but Ledger's dead and they really need to just move on and start fresh. It's not like there aren't continuity problems with Batman Begins and TDK. Why worry now?

Wow, this would be pretty awesome! I hope they follow through with it. Ledger deserves it!
