I do not think you would get in trouble, LSU would send you a letter, telling you to stop selling them.

Looks good. JMHO, but fewer smooth lines *more jagged* and outline the color borders with a narrow tip brush to add depth.

It is definitely covered by copyright and trademark. You do not need to mark copyrighted material to assert the protection, but federal registration is prerequisite for litigation in federal court.

I read an article about a family or group that customized an RV in 2009 and had to pay to use LSU images on the vehicle. There is a sports licensing office that contracts with a company that specializes in licensing.

So you think she would run into problems? She'd have to contact LSU liscensing people?

What if she just sells copies to friends? She's not really making much on top of material and time.

Appreciate ya'll helpin us iron it out. I know LSU is a stickler about their brand.

I can't tell you this but if you change it by at least 10% (whatever 10% you want to change), you can take advantage of a loophole. Technically, you don't have to change the color, but if you change the hue (like a darker purple or brighter gold), you can't really get in trouble. But I can't tell you that, or I'd have to kill you.

hmmmmmmmm and how would you know that? Would you have to kill me if you told me? I heard change by 20% and you say 10%. How can they verify what color it is in the painting vs. their sanctioned "gold"?

By the way, as similar as it is, it really is sketched free-hand. So if it's not traced and therefore an "exact replica" does that play into it at all?

You know, I didn't read your original post and didn't know it was an artwork. I might have to do a little more research on this. I'm kind of interested now.

quote:

Painting Commemorating Tiger Woods' Masters Tournament Victory Results in a Lawsuit In 1997, Tiger Woods became the youngest player ever to win the Masters Tournament, setting a 72-hole record for the tournament and a record 12-stroke margin of victory. Subsequently, in 1998, sports artist Rick Rush created a commemorative painting of the tournament entitled the "The Masters of Augusta," featuring three views of Woods in different poses, along with images of other individuals. Due to the fact Rush had not obtained permission to create the painting, Woods' licensing agent, ETW Corporation (ETW) filed a lawsuit against Rush's publishing company. The complaint alleged that the painting infringed its trademark and violated Woods' right of publicity. As Woods' licensing agent, ETW owns the exclusive right to use Woods' name, image, likeness, signature and all other publicity rights for commercial gain. In addition, ETW owns a U.S. trademark registration for the mark "Tiger Woods." These rights allow ETW to control (to the exclusion of all others) the manner in which references to Woods, in various forms, are used for profit. Despite the imposition of such protections, Jireh Publishing, Inc. (Jireh), the publisher of Rush's artwork, sold and distributed limited edition prints of Rush's painting. Jireh enclosed the prints in a white envelope and included a narrative description of the painting, in which Woods' name appeared. In addition, on the back of the envelope, under the flap, the words "Tiger Woods" were printed.

Most likely, this is what would happen. If, and I mean if, LSU found out about this, they would contact you and ask you to stop. That's my best guess. If it were turning a big profit, they would ask for their share.

My mom paints wine glasses with logos on them all the time for lots of schools and sells them. She has been doing it for a while and none of the schools have sent her anything about stopping.
