I posted this in a earlier thread:
So now I pose this:
The contract is set to end in Dec of 2012. If in fact Okeefe did extend it to 2014 now it ends in Dec of 2014. If as southern man suggests that no amendment or letter to Miles is needed to extend by a year. What happenes this year if Miles wins 8 games. Does the contract extend to 2015?
Bascically what I am trying to get at is if no paperwork is needed to extend that contract and lets assume Miles starts winning the hearts of the Tiger faithful. Come five years from now Miles can have a contract that no one has signed off on.
Am I making any sense.

I know 40 pages may be to long for some on the rant but it says on page 7 dated March 12, 2008:
" 3. In exercising the discretion granted in the employment agreement and amendments as to whether to grant a one year term extension, the Chancellor will be guided by the following:
A. Winning eight games or more games in a season presumptively will be the basis for a one-year term extension.
B. A decision by the Chancellor not to grant a one-year term extension for any reason must be concurred in by the President of the LSU System.
4. It is understood that the President and Chancellor will recommend to the Board at its next regular meeting that the provisions ........... be amended to change the amount referenced therin from $15 million to $18.75 Million.
So it is not automatic that he get the roll over with 8 wins and it it up to the Chancellor to make the decision the the President has to concur and the Board has to sign off on it.

You do realize 5-7 probally gets some team to a bowl this year. Read this article to find out more information. I hope LSU does not keep CLM if he only gets the Tigers to a bowl game.

I'm gonna call Wednesday night and ask about his contract...

Question...
If a news org or pay site quotes someone like the Chancellor saying the buyout is 11.3 mil after this season, should that be a factor in this discussion or is it disregarded?

That's the point, there is no "automatic rollover." The word automatic is found no where in the contract neither is the word "rollover."
Let me try this another way
The March 12, 2008 extension, in Article 3, specifically states:
In exercising the discretion granted in the employment agreement and amendments as to whether to grant a one-year term extension, the Chancellor will be guided by the following: (Note this does not say ‘may be guided’ it says ‘will be guided’)
A. Winning eight or more games in a season presumptively will be the basis for a one-year term extension.
(Note: I’ll define presumptively since people seem to be confused by my use of the word automatic: Presumptive is an adjective meaning to afford ground for presumption which is a noun meaning the act of presuming or the assumption of something true.)
B. A decision by the Chancellor not to grant a one-year term extension for any reason must be concurred in by the President of the LSD System.
(Note: From this point we see that it is the act of NOT granting the extension that requires action and MUST be concurred by the President, ergo NO action is needed for the presumptive basis for the extension which is eight or more wins.)
Miles did in fact win 8 games in 2008 and 2009 therefore the contract presumptively, some might say ‘automatically’ extends one year for each.
If the Chancellor chose not to grant the extension (<8 games won or he was swayed by reading the rant or whatever) he would have to gain the approval of the President of the LSU System which should be public record and subject to the freedom of information act.
Given that information and absent any amendments or documentation from the Chancellor AND President to the contrary, which again would be public record, the contract expires 12/31/2014 and it would cost LSU up to $15M to fire him after this season.

If the Chancellor has made a statement on the record that the buyout is 11.3 after this season that would indicate that the DID, IN FACT, decide specifically to NOT roll over one year (I would guess 2008) and would have officially notified CLM of said decision.
That information is part of the contract record and would be subject to the FOIA but to my knowledge has not been put forward by any news organization.
If you know of a credible link to such a quote by the Chancellor or an official within the University System then by all means share.

For what it is worth and it may be nothing, Randy Rosetta of the Advocate was on ESPN radio yesterday and stated that Miles' contract runs through 2014. The buyout is actually a little over $15 M according to Rosetta. Not stirring the pot, but telling you what was on the radio yesterday.

From a pay site so cannot share... And not saying it was the Chancellor but it was from someone near that level

So, next year, after 4 years of getting rolled by Bama, LSU nuts up and buys Miles out for 3.75...
This...and by that time, so much damage has been done, whether it be through coaching snafus, negative recruiting, etc., that LSU is badly tarnished.
