Could they not actually be charged with a crime if they did such a thing as this. As a soldier is your duty not more to following your Constitution and protecting citizens, than it is to following some orders. Haven't some Nazi soldiers and many others been charged with war crimes of which they followed their orders. Simply doing something because you were ordered to do it doesn't make it not criminal.
