For some yes. Not everyone. I’ve seen fatale crashes with that ammount.
Some cops will push the limits to get a dui at that level. The standard filed sobriety tests should be taken into account at this level. They’re standard for a reason. If an officer sees impairment but not enough to meet the “standard” you shouldn’t arrest because they are above .04 but below a .08.

None of the description mentions motor skill impairment. That's why that level is not illegal.
