I'm torn. Since it is almost exclusively used by blacks against other blacks, it seems more a direct character assassination than strictly "racial" to me. However, as the race of the recipient is, more or less, a requirement, I can see why someone would consider it racial.
There is no question it is a slur.

For anyone who has read Uncle Tom's Cabin, the character Tom was a person of very high moral character and the term when used, should be a compliment.

And given that a significant portion possibly even the majority of the black population is functionally illiterate they continue to use it incorrectly as a slur.
Uncle Tom is the most sympathetic and selfless person in the Novel. He literally embodies all of Jesus's teachings.
