A judge didn't overturn it. An appellate (10th Court of Appeals) court overturned it. Yes, all 3 judges on the appellate court went to Baylor Law but if you read the actual opinion, I think most would agree with it. They didn't even address the biggest concern in their decision, the prosecution intentionally (or ignorantly) misleading the jury.
