If it's legal on the federal level there isn't a damn thing the necks can do to stop it on a state-by-state basis. Federal law trumps state law.

If it was legalized on a federal level they wouldn't outright legalize it, theyd just remove the criminal aspect of it. Notice the difference- i.e. one is stipulating that they won't punish you for having it, versus giving you permission to have it. The States would still be free to prohibit it or legalize it as they see fit. A great parallel is alcohol. States are free to raise or lower the age as they see fit- it's not a federal power.
