In fairness to the vic, he might not have known. Anyone sleazy enough to cheat on her husband while he was on duty is also sleazy enough to lie to her boyfriend and say she's single or divorced.

If a fight broke out when he busted them, the shooting might have been legitimate self defense. The system will have to sort that out.
