He is the defendant. This suit exists if Winston wants to move on or not, which he does. When you get sued, you reply to the accusations and also "sue" the other person through a counterclaim. It is the same case, the same trial. It can even be strategically beneficial to go on the offensive in the answer. This doesn't exist if the initial civil suit isn't started by the female accuser. The best case for Winston is if this all went away, but since it is not, this is part of the pretrial.

This. If you don't counter-sue, there is zero chance that the woman is going to drop the case with millions on the line. But if her own arse is out there as well, it may just go away.
