Just a general question:
Should the responsibility of the driver change at all if the victim wasnt wearing a seatbelt?
In this case, the 2 victims wearing seatbelts had only moderate injuries.

I'm glad you brought that up, as it will now become a major point of contention within the context of this thread.
IMO, no seat belt is irresponsible behavior. When you get in a car, not wearing a seatbelt is taking your life in your own hands.
Consequentially, whoever the driver was is also to blame.

Not sure how that would apply to a minor.
